This is an English translation of the Condiciones Generales de Contratación, provided for information. The language of the contract is Spanish and, in case of any discrepancy, the Spanish version prevails.

These General Terms and Conditions (the “Terms”) govern the contractual relationship between Carlos Oller, owner of the website https://spanishsinfronteras.com (the “Owner” or “Spanish Sin Fronteras”), and any individual or legal entity that purchases the services offered through the Site (the “Customer”).

Purchasing any of the services implies express and unreserved acceptance of these Terms, as well as of the Legal Notice, the Privacy Policy and the Cookie Policy.

1. Owner details

  • Owner: Carlos Oller Berbel
  • Tax ID (NIF): 76635801P
  • Address: Calle Pi y Margall, 19, 04630 Garrucha, Almería, Spain
  • Email: hola@spanishsinfronteras.com
  • Phone: +34 641 67 98 59
  • Activity: Teaching Spanish as a foreign language

2. Purpose of the contract

The purpose of this contract is the provision by the Owner to the Customer of Spanish-as-a-foreign-language teaching services, online and by video call, according to the pack purchased.

The services include:

  • One-to-one or pair classes with Carlos Oller, a qualified native teacher.
  • Personalised teaching materials, provided through digital channels.
  • Progress tracking and regular feedback.
  • Access to the customer area to manage the subscription.

Classes are given through the video call platform agreed with the Customer (usually Zoom or Google Meet). The date and time of each class are agreed by both parties, depending on their availability.

3. Capacity to contract

To purchase the services, the Customer must:

  • Be of legal age (18, or the legal age in their country of residence).
  • Have the legal capacity to enter into contracts.
  • Provide true and up-to-date information during the purchase process.

Minors may only purchase the services with the express consent of their parents or legal guardians, who will be responsible for complying with the contract.

4. Purchase process

The purchase process has the following steps:

  1. The Customer selects the desired pack on the packs page.
  2. Adds the pack to the cart and proceeds to checkout.
  3. Fills in the billing details and selects a payment method.
  4. Expressly accepts these Terms by ticking the corresponding box.
  5. Confirms the order and makes the payment.
  6. Receives a confirmation email with the details of the purchase.
  7. Is contacted to agree the date and time of the classes.

The contract is concluded when the Customer receives the order confirmation email. The language of the contract is Spanish. The Owner keeps an electronic record of the contract document; the Customer can request a copy by writing to hola@spanishsinfronteras.com.

5. Prices and taxes

Pack prices are shown in euros (EUR) on each product page. Language teaching services may be exempt from VAT under Article 20.1.9 of Spanish VAT Law 37/1992 when they are provided by duly accredited teaching staff. If the exemption does not apply, the corresponding VAT will be shown separately.

If the Customer pays in a currency other than the euro, the conversion is made by their bank or by the payment processor (Stripe) at the exchange rate in force at the time of the charge, plus any fees their bank may apply. The Owner does not add any extra currency exchange charge.

The Owner may change prices at any time. New prices only apply to purchases made after they are published and do not affect active subscriptions until the next renewal (see section 8).

6. Payment methods

Services are paid exclusively by credit or debit card through the secure payment gateway of Stripe Payments Europe Ltd. The main card brands (Visa, Mastercard, American Express) are accepted, as well as Apple Pay and Google Pay where available.

The Owner never stores the Customer’s card details. They are processed directly by Stripe in its secure environment, certified PCI DSS Level 1.

For purchases that require additional authentication (3D Secure / PSD2), the Customer must complete the verification with their bank.

7. Subscriptions and automatic renewal

The packs offered on the Site are monthly subscriptions with automatic renewal. Unless the Customer cancels beforehand, the subscription will renew automatically every month on the same date as the initial purchase, charging the corresponding amount to the payment method provided.

The Customer will receive a reminder email before each renewal.

8. Changes to the pack or the price

Changing pack: the Customer can switch to a higher or lower priced pack by writing to hola@spanishsinfronteras.com. The change will apply from the next renewal, without affecting the current cycle.

Price changes: any change to the price of the purchased pack will be notified to the Customer at least 30 days before the renewal date. The Customer may:

  • Accept the new price (no action needed; it will apply from the next renewal).
  • Cancel the subscription before the renewal at no additional cost.

9. Cancelling the subscription

The Customer can cancel the subscription at any time, without giving a reason, in any of these ways:

  • From the customer area: “My account” → “Subscriptions” → “Cancel”.
  • By writing to hola@spanishsinfronteras.com from the email address linked to the account.

Cancellation takes effect at the end of the current billing cycle: the Customer keeps access to the classes already paid for until the end of the month purchased. No pro-rata refunds are made for unused days of the current cycle.

10. Right of withdrawal

Under Spanish Royal Legislative Decree 1/2007 (TRLGDCU), Customers who are consumers have 14 calendar days from the date of purchase to withdraw from the contract without giving any reason.

To exercise this right, the Customer must notify it unequivocally by email to hola@spanishsinfronteras.com, stating:

  • Full name and address.
  • Date of purchase.
  • Pack purchased.
  • An express statement of their wish to withdraw.

Exceptions to the right of withdrawal: the right of withdrawal does not apply when the service has been fully performed within the 14-day period, provided that performance began with the Customer’s prior express consent and their acknowledgement that they would lose their right of withdrawal once the contract had been fully performed (Article 103.a TRLGDCU).

If the Customer has already received any class within the 14 days, the amount proportional to the services actually provided will be deducted from the refund.

The refund will be made using the same payment method used for the purchase, within 14 days at the latest from receipt of the request.

11. Failed payments

If the automatic charge for a renewal fails (card declined, insufficient funds, etc.), Stripe will automatically retry the charge on days 3, 5 and 7. The Customer will be notified by email of each failed attempt.

If the payment is still not completed after these attempts, the subscription will be suspended and access to classes will be paused until the Customer resolves the situation by updating their payment details from the customer area.

12. Missed and rescheduled classes

Classes cancelled by the Customer less than 24 hours in advance will be considered as given and cannot be rescheduled. Classes cancelled more than 24 hours in advance can be rescheduled by mutual agreement within the same billing cycle, subject to availability.

Classes not used within the month purchased cannot be carried over to the next cycle, unless expressly agreed by the parties.

If the Owner is unable to give a scheduled class (illness, force majeure), it will be rescheduled at no additional cost to the Customer.

13. Customer obligations

The Customer agrees to:

  • Provide true and up-to-date information.
  • Keep their payment details up to date.
  • Attend scheduled classes on time with the necessary equipment (internet connection, camera, microphone).
  • Use the teaching materials provided for personal, non-commercial purposes only.
  • Not reproduce, distribute or share the classes or the materials with third parties.
  • Treat the Owner with respect and professionalism.

Serious breach of these obligations may lead the Owner to terminate the contract, with no right to a refund of unused classes.

14. Intellectual property

All teaching materials (audio, videos, worksheets, presentations, exercises) provided to the Customer are the intellectual property of the Owner or of their lawful owners. They are provided to the Customer exclusively for personal and educational use within the service purchased.

Copying, reproducing, distributing, publishing, transforming or exploiting these materials without the Owner’s express written authorisation is prohibited.

15. Limitation of liability

The Owner undertakes to provide the services with due diligence and professionalism. However, the Owner shall not be liable for:

  • Service interruptions due to external causes (failures of the video call platform, problems with the Customer’s connection, power cuts, etc.).
  • The specific level the Customer reaches, which depends on many factors (personal effort, frequency of practice, learning ability).
  • Indirect damage, loss of profit or loss of opportunity.

In any case, the Owner’s maximum liability to the Customer shall not exceed the total amount actually paid by the Customer in the last 12 months.

16. Personal data protection

The processing of the Customer’s personal data is governed by the Privacy Policy, which forms an integral part of these Terms.

17. Changes to the Terms

The Owner reserves the right to modify these Terms to adapt them to new legislation or to changes in the service. Changes will be notified to the Customer at least 30 days before they come into force, by email or through a prominent notice on the Site.

If the Customer does not accept the new Terms, they may cancel the subscription before they come into force at no cost. Continued use of the service after they come into force implies acceptance of the new Terms.

18. Assignment of the contract

The Customer may not assign the rights and obligations arising from the contract to third parties without the Owner’s express written authorisation. Classes are personal and non-transferable.

19. Severability

If any clause of these Terms is declared void, in whole or in part, this will not affect the validity of the remaining clauses, which will continue to apply in full.

20. Applicable law and dispute resolution

These Terms are governed by Spanish law.

To resolve any dispute arising from the contract:

  • Where the Customer is a consumer, the courts of the Customer’s place of residence will have jurisdiction.
  • In all other cases, the parties submit to the courts of Almería (Spain), expressly waiving any other jurisdiction.

Alternative dispute resolution: in accordance with Regulation (EU) 524/2013, consumers can use the European Union’s Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr/
